Law, Weathers & Richardson successfully represented Grant Township in an appeal by a landowner/developer to the Michigan Court of Appeals in Grant Township v VanderWall, et al (unpublished decision decided June 13, 2006, Case No. 258102). This case involves important issues regarding land divisions, the old Subdivision Control Act, the new Michigan Land Division Act, zoning and estoppel. Grant Township had prevailed in the Newaygo County Circuit Court, but the landowner/developer appealed the matter to the Michigan Court of Appeals. The Court of Appeals upheld the decision of the trial court in Grant Township’s favor. A copy of the opinion by the Court of Appeals can be accessed by clicking here.
This was the second court case involving Grant Township and the same (or related) landowner/developer. In 2004, the Michigan Supreme Court held in favor of Grant Township in a case which involved the new Land Division Act. That case, Sotelo v Grant Township, 470 Mich 95 (2004), can also be accessed by clicking here.
