Bankruptcy

We represent secured and unsecured creditors in workout, liquidations, and bankruptcy related actions. We negotiate out-of-court restructuring and forbearance agreements, debtor-in-possession financing, and, when appropriate, liquidation plans. We work with our Litigation Practice to defend preference actions, fraudulent conveyance claims, and objections to claims.

Specific services for clients include:

  • Reviewing bankruptcy petitions, schedules, and statements of financial affairs.
  • Negotiating with debtors-in-possession, trustees, and committees regarding every aspect of clients’ interest as affected by bankruptcy process.
  • Preparing and reviewing disclosure or insolvency statements and plans of reorganization.
  • Analyzing documentation, claims, and collateral.
  • Preparing proofs of claim and defending objections to proofs of claim.
  • Seeks judgments and recovery of personal property.
